We have created this privacy policy for visitors to the https://jabama.pl/ website (hereinafter the “Website”), the Jabama online store (hereinafter the “Store”).

The administrator of your personal data in connection with the use of the Store is: Jabama Polska sp. z o.o. with its registered office at: Chrośla ul. Lawendowa 75, 05-311 Dębe Wielkie, registered in the Register of Entrepreneurs of the National Court Register under KRS: 0000875584, NIP: 8222384494.

I. Cookies and other technologies

We use cookies and other similar mechanisms to learn how users use our Website and for marketing purposes, including displaying advertisements to them elsewhere on the Internet.

# What are cookies?

A cookie is a small text file stored by a website on your computer, phone or other device on which you browse the website. The cookie contains data about your use of the website.

Some cookies are essential to the operation of our Store, and cannot be turned off.
In other cases, the first time you visit our Website, we ask you to agree to the installation of cookies. We do not use advertising or analytics cookies (or any other non-essential cookies) without your consent.

 

# What cookies are we using?

  1. Essential cookies
    • These cookies are used to make the website work properly. You can't turn them off, because if you turn them off, our website simply won't work properly.
    • In this regard, we use a tool that stores your privacy settings. It shows your consent or lack thereof to run particular types of cookies on our website.
    • Other necessary cookies on our Website are used for the proper functioning and management of the Website, including making changes to the Website and running tracking tools that you agree to.
  2. Statistical analysis of our Website
    • We use tools that collect analytical data to help us understand how users use our Website. The data we receive from these tools does not give us information about a specific individual known by name, but allows us to record various aspects of a user's use of the Website. We may aggregate and analyze this data statistically, and use it to make decisions about changes to our Store and/or how we conduct our advertising and marketing communications.

    • We use advertising tools so that we can display our ads on other sites you visit, including social media (known as targeted ads), measure the effectiveness of our advertising campaigns, and match the content of our targeted communications to you with information we have about you.
    • A list of the advertising tools we use on the Website, along with an explanation of (i) who is the provider of the tool, (ii) what exactly it is used for - can be found in Appendix 1 to this policy, and briefly in the cookie consent management panel.
  4. Functional cookies
    • Some cookies on our website are used to run an additional tool on the Store's website, such as chat, a module for adding product reviews and/or stars, the ability to recommend a product to a friend, the ability to show you recently viewed products in our Store, etc.
    • You can find a list of the functional tools we use on the Website, along with an explanation of what exactly they are used for, in the cookie consent management panel.
  5. Social media plugins and links
    • We have included links to our social media profiles on our Website: Facebook / Instagram / LinkedIn. If you visit our profile on a particular site, the owner of that site will receive - just as when users go from any other website to another website - a notice that you have reached those sites from our Store.

  6. Videos
    • Some videos on the Website are embedded using plug-ins from YouTube (a service owned by Google). When you play such a video on our Website, Google receives information about it from your browser, even if you do not have a Google/YouTube profile or are not logged in at the moment. If you have previously logged in to the aforementioned service, this service provider will be able to directly assign the video playback to your profile.
    • If you want to prevent Google from collecting information about your activity on our Website, you can:
      • not play the video (We will treat your consent to play the video as consent that also applies to other videos on our Website - until you revoke it, i.e. change your cookie choices),
      • not consent to cookies from this service on our Website,
      • or you can log out of this service.

    • Some videos on the Website are embedded using plug-ins from Vimeo. Therefore, cookies of this service are used on our Website, but they are not used for advertising or analytical purposes (they do not track your playback of videos on our Store).

# Legal issues regarding cookies

The legal basis for the Store's use of essential cookies (indicated above in the “What cookies are we using?” section) is our legitimate interest, i.e. the right to operate the Website to support our business, and the need to maintain its security.
The legal basis for our use of other cookies is your consent.

In connection with our processing of your personal data through cookies, you have rights at any time, which we write about below.

Our use of cookies, in particular for advertising purposes, may involve so-called profiling. This means that we, or the marketing companies we use, may create a profile of you based on the information we collect (e.g. email address, order history, type of device, technology used, frequency of visits) and, based on this, formulate purchase forecasts for the future. This allows us to decide what content (including ads) to display on our and other Websites.

# How long do cookies stay on a user's device?

It depends on whether they are “persistent” or “session” cookies. Session cookies, i.e. information necessary for your browser's functionalities to work properly, expire when your session ends, i.e. each time you close our Website. Persistent cookies, which make using the Website easier (e.g., remembering the selected resolution, content layout, user preferences, last viewed products) will be stored by your browser for longer and will remain there until the expiration date, unless you delete them yourself sooner using the settings in your browser menu.

Third-party cookies (i.e., analytics, advertising and social media-related cookies) are subject to their own privacy policies, to which we provide you with links in this policy.

II. Other purposes of processing personal data of Store users

It is not mandatory for you to provide the above data, but it is necessary in order to process your order, invoice you, notify you of the status of your order, respond to your inquiry or complaint, etc.

# How long do we process the data?

We process your data related to placing an order with the Store for as long as it is necessary to complete the order, and according to accounting and tax regulations.

In addition to this, we will process your data for the time necessary to achieve the purposes listed in the table above (and thus until our legal interest allowing us to process ceases, or until you object to the processing, or until you withdraw your marketing consent - if you have given us one). Further processing will be possible only if we, as an administrator, are under such a legal obligation (in particular, for tax purposes) and possibly for archival purposes to safeguard against possible claims (until the statute of limitations for such claims).

# Who do we share your data with?

In our business we use the services of other cooperating companies, so your data may be entrusted by us: the company that provides us with the software to run the Store, the accounting company, the host of our Website, the host of our e-mail, other companies whose services and marketing tools we use. Your data is also transferred to courier companies and payment intermediaries, if any, in order to process your order, these companies being separate controllers of your personal data.

For the purposes of the marketing activities described above in the “Cookies” section, we use services provided by US-based entities (Google, Facebook). In connection with the above, your personal data may be transferred to third countries that are not members of the European Union. In doing so, an adequate degree of protection for your data is provided by the Data Privacy Framework program, which you can read more about here.

# Your rights in relation to data processing

We are committed to respecting the confidentiality of your personal information and to ensuring that you can exercise your rights. You can exercise your rights at no cost to you by emailing us or otherwise contacting us.

Remember that in connection with the processing of your data, you have the right to:

  • request from us access to the data we hold about you;
  • rectification of your data;
  • delete your data if it is no longer needed for the purposes for which it was processed, or we have no other legal basis for processing it;
  • revoke your consent to the processing of your personal data, if you have given such consent;
  • object to the processing of your data if we process it on the basis of a legitimate interest;
  • limitation of data processing;
  • file a complaint with the Chairman of the Personal Data Protection Office if you believe that your data is being processed by us unlawfully.

APPENDIX NO. 1 TO THE PRIVACY POLICY OF THE Jabama STORE
- LIST OF ADVERTISING AND ANALYTICAL TOOLS THAT USE COOKIES

  1. ANALYTICAL COOKIES:
    1. We use Google Analytics
      • The information Google Analytics collects about users includes, for example: how many times a user visits the site; which subpages the user visits; the date of the first and last visit; the duration of the visit; the Website from which the user visited the site (source of arrival); the browser the user uses; the link the user clicks; the location in the world from which the user accesses the site, the anonymized (abbreviated) IP address, etc.
      • Google assigns individual users their own identification (the so-called Google ID) and collects data obtained from cookies from various Websites on its servers. We - as the owner of the Website - may receive reports (statistics) from Google related solely to traffic on our Website. These reports, of course, include only those individuals who have consented on our Website to have their visits recorded by Google Analytics.

      • You can also permanently prevent Google Analytics from logging information from your browser by installing a special plug-in found here.
    2. Cookies from our Store's software provider
      • The provider of the software through which our Store operates - i.e., the owner of the shoper.pl platform - places cookies on our Website in order to collect aggregate information about how customers use online stores (sub-pages opened and time spent on them, products displayed, clicks on the Store's website, analytical information about purchases, such as conversion rates).
      • The data is used to create aggregate reports for e-store owners, containing general (no personal data) information about, among other things, what products interest a store's customers, at what time of the year there is increased store traffic or sales, etc. This allows retailers (including us) to improve their stores and optimize sales processes.

  2. ADVERTISING COOKIES:
    1. We use Google Ads and other Google advertising tools
      • Google collects on its servers the data obtained from the cookies placed on your device. This data is collected from all sites where you have allowed Google to use cookies for advertising purposes (including our Website), as well as from ads you have clicked on. Google uses this information to display ads on other Websites you visit. Typically, cookies from Google expire after 3 months.
      • We, as advertisers using Google's services, do not have access to the cookie data stored on your device, but we can commission advertisements to audience groups with characteristics we choose, e.g. to all people who have visited our Website (or its specific subpage) in the last 7 days. This data is only statistical material for us, and we only commission commercials based on aggregate criteria (to specific target groups, not to a specific user).
      • We may also use (as part of our use of the Google Marketing Platform) tools that allow us to measure the effectiveness of advertising campaigns (e.g., how many people clicked on a particular ad over a certain period of time).

    2. LinkedIn Insight Tag
      • We use the so-called “LinkedIn Insight Tag” to manage advertising and our communications on LinkedIn.
      • If you consent to the use of this cookies on our Website, then through this tool, the LinkedIn service obtains information that you have visited our Website. This information is assigned to your profile on this service, if you have one. If you are not a user of this service, then the information is assigned to the so-called “LinkedIn ID” created for you.
      • This allows us to outsource advertising on LinkedIn to those people who have already visited our Website or its individual subpages (remarketing), measure the conversion of our ads on LinkedIn, and match our communications on LinkedIn to the overall profile of our Store's users.
